This Criminal Original Petition has been filed seeking a direction to the respondents 1 and 2 to instruct the third respondent not to harass the petitioner under the guise of the enquiry pertaining to a civil dispute without following due process of law.
2.According to the petitioner, he attested as witness in an agreement entered between the private respondent and one Sundar. While so based on the said agreement, there is a dispute between the private respondent and said Sundar. Therefore, the private respondent lodged a complaint against the petitioner and the said Sundar, based on the same, the third respondent frequently called the petitioner by interfering with the civil dispute. Therefore, the petitioner sent the representation dated 08.04.2025, but the same has not been considered. 2/5
Hence this petition.
3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that based on the complaint lodged by the fourth respondent, they called the petitioner for enquiry and apart from that they have not harassed the petitioner. They will conduct enquiry upon the fourth respondent's complaint and dispose of the same, in accordance with law, within a period of fifteen days. 4.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondent, is inclined to pass order.
5.According to the petitioner, the third respondent harassed him under the guise of enquiry. The third respondent denied the said allegations and submitted that based on the complaint lodged by the fourth respondent, they called the petitioner for enquiry and apart from that no harassment was made to the petitioner. 3/5
6.Recording the said submission, this Criminal Original Petition is closed.
