For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No 68 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/A2 and A3, who apprehend arrest at the hands of the respondent Police for the offences punishable under Section 306 of IPC in Crime No.68 of 2023 on the file of the respondent Police, seek anticipatory bail.

2.The defacto complainant is the husband of the deceased and he is working as a mill employee in Coimbatore and they are having five female child and the deceased was working as Supervisor under Hundred Days scheme. The scheme of the daily wages was reduced and when the same was questioned by the deceased there was dispute between the deceased and the accused persons. Hence the deceased has given complaint to the police no action has been taken and thereafter on 12.04.2023 at about 12.00 pm., the deceased went in the bus to give complaint to the superior officers at that time due to frustration the wife of the deceased fell down from the bus and committed suicide, hence the case.

4. It is seen that there are totally three accused in this case and the petitioners herein are A2 and A3. It is seen that the deceased was working under 100 days scheme. The accused persons being member and President of Maiyittanpatti village refused to give employment because of her conduct and also harassed her. Therefore while the victim while travelling in the bus along with her children she jumped out of the bus and died. She has also left suicide note. A perusal of the suicide note revels the fact that there are specific allegations as against all the accused persons. That apart the villagers are refusing to receive the body from the hospital till the accused were arrested, therefore custodial interrogation of the petitioners is very much required in this case, hence this court is not inclined to grant anticipatory bail to the petitioners.
