ORDER

This Criminal Original Petition had been filed seeking for a direction against the second respondent not to harass the petitioner in the name of enquiry, on the basis of the petitioner's representation, dated 17.04.2023.

2.The learned Additional Public Prosecutor would submit that the second respondent was directed by the learned Judicial Magistrate, Theni to enquire the complaint given by the third respondent against the petitioner. Based upon the order, summons was issued to the petitioner to appear for enquiry on 14.04.2023. But the petitioner failed to appear before the second respondent, even on receipt of summons. Seeking a direction, the petitioner has filed this petition.

3.Since the second respondent is conducting enquiry based upon the order passed by the learned Judicial Magistrate, Theni. The petitioner has to co-operate with the enquiry. There is no harassment on the side of respondents Police. If the petitioner finds any trouble during enquiry, he is directed to work out his remedy through appropriate proceedings. 2/4

4.With the above directions, this Criminal Original Petition stands disposed of.
