ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 323, 506(i) I.P.C r/w Section 4 of Prohibition of Harassment of Women Act, 2002, and Section 3(1)(r), 3(1)(s) of the Schedule Caste and Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015, in Crime No.65 of 2018, on the file of the respondent police, seek anticipatory bail.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.
3.Though this Court passed an order in favour of the petitioner on earlier occasion, the petitioner could not surrender and execute the sureties within the stipulated time. The learned counsel for the petitioner submits that he could not do so due to certain reasons beyond his control. His explanation is accepted. https://hcservices.ecourts.gov.in/hcservices/
4.The petitioner is permitted to surrender before the Jurisdictional Special Court within a period of two weeks from the date of receipt of a copy of this order. The petitioner is permitted to inform the defacto complainant by a registered post regarding his date of surrender, when he shall apply for regular bail.
5. The Special Court is directed to consider and dispose of the petitioner's bail application on the same day of surrender.
