Prayer in Cont P(MD)No.766 of 2015 Petition filed under Section 11 of Contempt of Courts Act, 1971 to punish the contemnor for his wilful disobedience of the order of this Hon'ble Court dated 18.01.2015 in W.P.No.448 of 2015.

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus, direct the respondents to pay the scale of pay and other allowances with effect from 2009 for the promotion post till the date of retirement on 31.10.2012 and consequently to settle pension and other retirement benefits such as gratuity and leave salary together with interest at the rate of 12 % for the delayed payment and to pass such further or other orders.

ORDER

The learned Standing Counsel appearing for the respondent submits that the arrears amount payable to the petitioner would be disbursed within a period of two months.

2.Based on the undertaking given by the learned Standing Counsel for the respondent, a direction is given to the respondent to disburse the arrears payable to the petitioner within a period of two months from the date of receipt of a copy of this order. The petitioner is at liberty to revive this application, if the direction given by this court is not complied with. With this direction, this Sub Application is closed.
