PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to direct the first respondent to provide adequate police protection to the petitioner's life and property in Plot No.25 to the extent of 900 sq.ft at Naranapuram Village, Sivakasi Taluk, Virudhunagar District forthwith, in the light of Judgment and Decree dated 15.06.2016 in O.S.No.204 of 2015 on the file of the Learned District Munsif Court, Sivakasi, Virudhunagar District.

ORDER

This Criminal Original Petition has been filed to direct the first respondent to provide adequate police protection to the petitioner's life and property in Plot No.25 to the extent of 900 sq.ft at Naranapuram Village, Sivakasi Taluk, Virudhunagar District forthwith, in the light of Judgment and Decree dated 15.06.2016 in O.S.No.204 of 2015 on the file of the Learned District Munsif Court, Sivakasi, Virudhunagar District.

2. The learned counsel for the petitioner submitted that the petitioner had made a complaint before the first respondent Police on 03.05.2022 to protect the properties and to take action against the third respondent. The complaint has been received by the respondent Police and CSR.No.244 of 2022 has been assigned. But no action was taken. 3. The learned Government Advocate submitted that after enquiry, the respondent Police closed the complaint on the ground that against the Civil Court decree, the alleged accused preferred an appeal and being a civil dispute, he closed the complaint.

4. I have considered the matter in the light of the submission made by the learned counsel for both the parties. Since the complaint has been closed, as the dispute involved is civil matter and an appeal has been preferred by the accused against the Civil Judgment, this Petition is closed.

5. Recording the same, this Criminal Original Petition is closed.
