PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- For Bail in Crime No. 764 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 19.06.2021 for the offences punishable under Section 8(c)r/w Section 20(b)(ii)(B) of NDPS Act, 1985 in Crime No.764 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the accused was found in illegal possession of 1.100kg of ganja on 19.06.2021. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

CRL OP(MD)No.8891 of 2021 4.The learned Government Advocate(Crl.side) appearing for the respondent police opposed this petition on the ground that investigation is not completed. It is his further submission that the petitioner has one similar case in Cr.No.165 of 2021. 5.It is a case of illegal possession of ganja and the petitioner has one similar previous case pending against him. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
