ORDER

(Order of the Court was made by DR.G.JAYACHANDRAN, J.) This writ petition is filed for a writ of mandamus directing the Union Government of India not to issue license for installing new petrol retail outlet in Survey No.162/3B for the fifth respondent, namely Nayara Energy Limited.

2.In the affidavit filed in support of the writ petition, it is contended that minimum distance between two fuel stations must be at least 500 meters, whereas the proposed petrol bunk is situated at a distance of less than 300 meters from the bunk of the petitioner. 3.During the pendency of the writ petition, Arulmigu Arungaraiyamman Agency got itself impleaded as sixth respondent in this writ petition stating that they are the distributors of the subject petrol bunk and have interest in the outcome of the writ petition. 4.Today, when the matter was taken up for consideration, the learned Government Pleader appearing on behalf of the official respondents states that so far, 'No Objection Certificate' has not been issued to the fifth respondent by the State for establishing petrol bunk in the said survey number.

5.The learned counsel appearing for the sixth respondent namely, impleaded respondent would submit that their application for outlet dealing is pending on the file of the second respondent. He would 3/6

also submit that the writ petitioner, namely Valliyathal, is no more and that she died on 06.02.2025. He has also produced the death certificate issued by the Corporation in support of such contention. 6.On appreciation of facts placed before us, we dismiss this writ petition. The authorities shall consider issuance of 'No Objection Certificate' or permission for establishing a petrol bunk in Survey No. 162/3B by scrupulously following the guidelines issued by the authorities in this regard and pass appropriate orders. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
