To pass an order of exemption from the payment of court fee of Rs. 43,527/- in the civil miscellaneous appeal filed against the Award dated 13.02.2026 passed in M.C.O.P.No. 84 of 2018 on the file of the Motor Accident Claims Tribunal ( Subordinate Court), Valliyoor and thus render justice.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking for exemption from payment of court fee of a sum of Rs.43,527/- in the civil miscellaneous appeal filed against the Award dated 13.02.2026 passed in M.C.O.P.No. 84 of 2018 on the file of the Motor Accident Claims Tribunal ( Subordinate Court), Valliyoor.

2.Heard the learned counsel on either side.

3. On carefully went through the award passed by the Tribunal, it is seen that even before the Tribunal, the petitioners have sought for exemption from paying the court fees and such exemption was granted. At

the time when the final award was passed on 13.02.2020, the petitioners were directed to pay the deficit court fee of Rs.27,689/-. Accordingly, the deficit court fee was also paid by the petitioners on 23.02.2026.

4. The main grievance expressed by the petitioners is that the owner of the vehicle was directed to pay the compensation amount without ordering for pay and recovery and the owner of the vehicle has not deposited the compensation amount till date.

5. In view of the above, we are inclined to exempt the payment of Court fee for the present.

6. This petition is accordingly allowed.
