This Criminal Original Petition has been filed seeking a direction to the respondents not to harass the petitioner herein under the guise of enquiry on the basis of the petitioner's representation dated 08.04.2025. 2.According to the petitioner, based on the complaint lodged by the fourth respondent, an FIR in Crime No.499 of 2024 has been registered as against the petitioner's husband. While so, now the third respondent frequently visiting the petitioner's house and thereby, caused harassment to the petitioner. Therefore, the petitioner sent the representation dated 08.04.2025, but the same has not been considered. Hence this petition.
3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that earlier, based on the complaint 2/5
lodged by the fourth respondent, an FIR in Crime No.499 of 2024 has been registered as against the petitioner's husband. Now, the said case was transferred to CBCID, Kanyakumari and thereafter, the petitioner's husband has been arrested. He would further submit that after transferring the said case to CBCID, Kanyakumari, the third respondent has no role in this case. Therefore, the third respondent has not harassed the petitioner as alleged in the petition.
4.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondent, is inclined to pass order.
5.According to the petitioner, the respondents 1 to 3 harassed her, thereby, she sent the representation, but the same has not been considered. The third respondent denied the alleged harassment and the FIR in Crime No.499 of 2024 was transferred to CBCID, kanyakumari and now the case is pending with CBCID, Kanyakumari. 3/5
6.Recording the above submission, this Criminal Original Petition is closed.
