O R D E R

The petitioner seeks issuance of writ of mandamus to direct the respondents to conduct survey based on the petitioner's application, dated 30.04.2024.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

3. The learned Additional Government Pleader would submit that survey was already conducted based on the petitioner's application and the same was partly complied by surveying 3 sites. However, on one site, survey could not be conducted because of the objections of the adjoining neighbouring land owners.

4. Recording the submission of the learned Additional Government Pleader, this writ petition is disposed of, directing the respondents to conduct survey and pass final orders on the petitioner's application, dated 30.04.2024. On fixing a date for the proposed survey, the 1st respondent shall inform the jurisdictional police officials in advance, who shall act on the said request and provide sufficient police protection to the 1st respondent to conduct peaceful 2/4

survey. The said survey shall be conducted in the presence of the petitioner and the adjoining neighbouring land owner, who is objecting to the survey and if any objections of the said neighbouring land owner are given, the same shall be considered and decided before taking a decision to proceed to survey. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of copy of this order.

5. With the above direction, this Writ Petition stands disposed of. No costs.
