: Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondent to return the driving license of the petitioner bearing TN 67-19860000269 to him forthwith.

ORDER

The petitioner has approached this Court seeking a direction, directing the respondent to return the driving licence of the petitioner bearing No.TN 67-19860000269 forthwith.

2. On instructions, the learned Additional Government Pleader appearing for the respondent would submit that the petitioner involved in motor vehicles accident, in which, a person died. Pursuant to the complaint forwarded by the Inspector of Police, a show cause notice was issued to the petitioner on 29.05.2018. The petitioner has submitted his explanation on 23.07.2018. As per Section 19(1) of the Motor Vehicles Act, 1988, the respondent temporarily suspended the licence for a period between 27.05.2018 and 26.06.2018. The learned Additional Government Pleader would further submit that since suspension period is already over, the petitioner is entitled to get back the licence.

3. In such circumstances, a direction is issued to the respondent to return the driving licence bearing No.TN 6719860000269 to the petitioner, as and when he approaches the respondent.

4. In fine, this Writ Petition is ordered accordingly. No costs.
