Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the first respondent vide proceedings in No.RO.TRY/109/2026-CA dated 04.03.2026 and quash the same as illegal and consequently to direct the first respondent to grant 21 days ordinary leave without police escort to the petitioner's husband, namely, Rameshkumar, S/o. Venkadasubbu, aged about 47 years, Convict Prisoner, PID No.405750 confined at Central Prison, Trichy. O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the proceedings of the first respondent made in No.RO.TRY/109/2026-CA dated 04.03.2026, wherein, the first respondent while granting ordinary leave for 21 days to the detenu, has imposed a condition that the detenu will be accompanied by an Police escort.

2. Heard the learned counsel on either side.

3. The detenu is a life convict and a representation was made by the petitioner, who is the wife, seeking for ordinary leave. The same was considered by the first respondent and the first respondent while granting 21 days ordinary leave, imposed a condition that the detenu will be accompanied by an police escort. This condition has been put to challenge in the present writ petition.

3. Taking into consideration the facts and circumstances of the case and considering the reasons assigned seeking for ordinary leave, this Court is inclined to modify the condition to the effect that the detenu shall report before the fourth respondent every day at 06.00 p.m., during the entire ordinary leave period. Apart from that condition, the detenu is permitted to execute the sureties before the Superintendent of Prison, Trichy, instead of executing the sureties before the Tahsildar and two sureties shall be the family members of the detenu. The other conditions imposed by the first respondent shall stand as it is.
