ORDER : The Court made the following order:- The petitioner, who is arrayed as A1 was arrested on 18/04/2022 and remanded to judicial custody for the alleged offences under sections 294(b), 498(A) @ 294(b), 498(A) and 306 IPC, in Crime No.52 of 2022, seeks bail.

2.The case of the prosecution is that the deceased was married to the accused, on 3/03/2006. They had two male children. Regarding the property dispute, a suit in O.S No.68 of 2011 was pending before the District Munsif Court, Aundipatti. On 11/04/2022, ear-boring ceremony was conducted. At that time, the accused persons demanded seervarisai. Over which, trouble arose. On 17/04/2022, the de-facto complainant received information from the accused stating that the victim consumed poison and was admitted in a private hospital at Chinnalapatti and later, she was taken to the Government Hospital, Dindigul, but died on the next day. On the basis of the complaint given by the brother of the victim girl, the case was registered. 3.Seeking bail, this petition has been filed and he was arrested, on 18/04/2022 and ever-since, he was in custody. 4.Heard both sides.

Crl.OP(MD)No.10185 of 2022 5.The marriage was performed between the deceased and the first accused, on 03/03/2006 and the date of occurrence is stated to be 17/04/2022.

6.Reading of the entire CD file shows that right from the marriage, there was heavy demand by the accused persons demanding dowry and money. So the victim girl left the matrimonial home and went to the parental home. In 2011, she lodged a complaint. There was a compromise between the parties. But later also, trouble has arisen. The accused persons said to have scolded the victim to bring money or die. Because of the torture meted out, she committed suicide, on 17/04/2022 at about 10.00 am, by consuming poison and later, died, on 14/06/2022. So, it appears that after a lapse of 16 years, suicide has been committed by the victim girl. Since the suicide occurred after seven years from the date of the marriage, the cases was not altered to offence section 304(B) IPC. 7.It is also seen that major portion of the investigation is also over and the petitioner is in custody more than the statutory period.

8.So without going into the merits of the matter, this court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Dindigul and on further condition that the petitioner shall report before the respondent police daily at 10.30 am until further orders.
