RESPONDENT/PLAINTIFF Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to grant an exemption form paying the balance court fee for a sum of Rs.10805 in this appeal and thus render justice. Prayer in A.S.(MD)No.SR25318 of 2021:

To call for the records relating to the judgment and preliminary Decree dated 28.02.2019 in O.S.No.54 of 2014 on the file of the Fast Track Mahila Court, Dindigul and set aside the same and allow this Appeal Suit.

ORDER :This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.SURESH KUMAR ISAAC PAUL, Advocate for the petitioners, the court made the following order:- This civil miscellaneous petition has been filed for exempting the petitioners from paying the balance Court fee of Rs.10,805/-.

2. Unless the incapacity of the petitioners to pay the said amount is formally declared, it will not be open to this Court to grant the relief sought for in this petition. This petition is dismissed. However, liberty is given to the petitioners to file an appropriate application in this regard.
