Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents to survey the petitioner's land in Survey No.762, situate in Shanmuga Sundarapuram Village, Andipatty Taluk, Theni District, to an extent of 1 Acre 39 cents, based on the petitioner's representation, both in person and through registered post with acknowledgement, dated 10.04.2023..

ORDER

The Writ Petition is filed, seeking a direction to the respondents to survey the petitioner's land in Survey No.762 at Shanmuga Sundarapuram Village, Andipatty Taluk, Theni District, with an extent of 1 Acre 39 cents, by considering his representation, dated 10.04.2023.

2. The petitioner herein claims right over the subject property under a settlement deed, dated 21.10.2022. Patta for the said property stands in the name of petitioner's father Paal Kannan and one Pandian. The petitioner submitted a representation before the respondents on 10.04.2023, seeking survey of the property. The same has not been considered. Hence, the petitioner has come before this Court.

3. The learned Additional Government Pleader, appearing for the respondents, would submit that the petitioner has not filed proper online application and hence his request has not been considered.

4. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to file proper online application

and produce acknowledgement of the same before the first respondent within a period of two weeks from the date of receipt of copy of this order and on submission of such online application, the first respondent shall consider the same and pass final orders on its own merits within a further period of twelve weeks, after issuing notice to petitioner, co-pattadar -Pandian, neighbouring land owners, and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. 15.07.2025 NCC :
