Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of certiorari or any other appropriate writ or order or direction calling for the records of the second respondent herein in his proceeding in I.D.No.40 of 2003 dated 10.04.2008,and quash the same. ORDER:- Writ Miscellaneous Petition coming upon for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. A.Jeyaram, Advocate for the Petitioner and of Mr.T.Ravichandran,Advocate for the 1st Respondent, this Court made the following order: The petitioner/Management has filed a writ petition in W.P (MD)No.9427 of 2009, challenging the order of the second respondent passed in I.D.NO.40 of 2003. W.M.P(MD)No.17638 of 2017 had dismissed the said writ petition for nonappearance of the petitioner's counsel. In order to set aside the said order, the petitioner has filed W.M.P(MD).No.17638 of 2017, which was allowed on condition that the petitioner should pay a sum of Rs.500/- towards cost to the Legal Services Authority, Madurai Bench of Madras High Court, Madurai and the said order was not complied with and hence, the said petition was dismissed. Thereafter, the petitioner/Management filed another petition to condone the delay in filing the restoration petition. This Court, by its order dated 04.11.2019, allowed the said petition on condition that the petitioner should pay a sum of Rs.2,500/- towards cost to the respondent, within the stipulated time.
2.When the matter is taken up for hearing today, the learned counsel appearing for the petitioner has produced a cost memo, dated 19.11.2019 and stated that the cost of Rs.2,500/- has been paid to the respondent.
3.In view of the above, the main writ petition is restored to file. The Registry is directed to list the writ petition on 04.02.2021 for final hearing.
