PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the first respondent in Na.Ka.No.121/Camp/SDOP/2022 dated 07.05.2022 and quash the same and consequently directing the first respondent herein to grant permission and adequate police protection for conducting the Kabadi Tournment at Aavaniyamman Kovil Thidal, Puliyangudi, Tenkasi District from 11.06.2022 at 10.00 pm to 12.06.2022 at 06.00 am.

O R D E R

This Writ Petition has been filed in the nature of Certiorarified Mandamus, seeking to quash the impugned order passed by the first respondent in Na.Ka.No.121/Camp/SDOP/2022 dated 07.05.2022 and direct the first respondent herein to grant permission and adequate police protection for conducting the Kabadi Tournment at Aavaniyamman Kovil Thidal, Puliyangudi, Tenkasi District from 11.06.2022 at 10.00 pm to 12.06.2022 at 06.00 am. 2.The learned Counsel appearing for the petitioner submitted that the petitioner has decided to conduct Kabadi Tournament at Aavaniyamman Kovil Thidal, Puliyangudi, Tenkasi District from 11.06.2022 at 10.00 pm to 12.06.2022 at 06.00 am, so that he gave a representation, seeking permission of the first respondent to 1/3

conduct the said tournament. But, the first respondent had rejected the representation. Hence, the petitioner has filed this petition. 3.The learned Government Advocate (crl.side) appearing for the respondents submitted that since there is no detailed events in the petitioner's representation, the first respondent rejected the same and now, the first respondent is ready to consider any fresh representation with full details, if given by the petitioner. 4.Admittedly, the petitioner had given a representation to the first respondent, seeking permission to conduct Kabadi Tournament at Aavaniyamman Kovil Thidal, Puliyangudi, Tenkasi District from 11.06.2022 at 10.00 pm to 12.06.2022 at 06.00 am, but with the impugned order, the first respondent rejected the same, on the ground that time and venue are not clearly mentioned in the representation. The circular issued by the Director General of Police for conducting any procession, is brought to the knowledge of this Court and in view of the same, the petitioner may approach the respondent police.

5.I have gone through the circular issued by the Director General of Police, where an elaborate guidance has been given to the police officials while granting permission for conducting processions and cultural functions. Therefore, the impugned order is hereby set aside and the petitioner is directed to give a fresh representation to the respondent police with all required particulars. Further, the respondent police is also directed to consider the representation, based on the circular issued by the Director General of Police and pass necessary orders. 6.With the above direction, this Writ Petition stands disposed of. No costs.
