PRAYER: Civil Revision Petition is filed under Section 227 of Constitution of India, to set aside the fair and decreetal order dated 17.03.2016 passed in I.A.No.197 of 2015 in O.S.No.55 of 2010 on the file of the Additional District Munsif Court, Thoothukudi. ORDER
The revision petitioner filed O.S.No.55 of 2010 before the Principal District Munsif Court, Thoothukudi. The revision petitioner sought the relief of declaration and permanent injunction. In the said suit, the third defendant filed I.A.No.197 of 2015 for returning the plaint on the ground of pecuniary jurisdiction. The said interlocutory application was allowed by order dated 17.03.2016. Questioning the same, this Civil Revision Petition is filed.
2.The learned counsel appearing for the revision petitioner submits that the revision petitioner shall abide by the order impugned in this Civil Revision Petition.
3.The revision petitioner shall re-present the returned plaint before the concerned Court, within a period of four weeks from the date of receipt of a copy of this order. The revision petitioner is at liberty to file a fresh application for injunction and also for appointment of Advocate Commissioner before the jurisdictional Court. If such application is filed, the same shall be disposed of within a period of four weeks, thereafter.

4.With these observations, this Civil Revision Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
