Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to take appropriate steps to make sure that no passenger alighting or boarding at Karupayeeurani is subjected unfair practices in violation of any of the provisions of Motor Vehicle Act or the rules or regulations or the G.O.Ms.NO.772, Home (Transport III), 16th October 2014 issued there under Motor Vehicle Act 1989.

O R D E R

(The order of the Court was made by S.MANIKUMAR, J.) Claiming himself to be a pro bono litigant, a practicing advocate of this Court has sought for a mandamus directing the respondents herein to take appropriate steps to make sure that no passenger is alighting or boarding at Karupayeeurani and that the passengers are subjected unfair practices, in violation of any of the provisions of Motor Vehicle Act or the rules or regulations or the G.O.Ms.NO.772, Home (Transport III), 16th October 2014 issued there under Motor Vehicle Act 1989.

2. Material on record discloses that on the very same issue, a Public Interest writ petition in W.P.(MD)No.3007 of 2014 has been filed in the Principal Bench of the Madras High Court by Coimbatore Consumer Voice representing by its Secretary Mr.N.Logu https://hcservices.ecourts.gov.in/hcservices/

against (1) The State of Tamil Nadu represented by its Secretary, Home (Transport) Department, Secretariat; (2) The Transport Commissioner, Transport Department, Ezhilaagam, Chepauk, Chennai 5 and two other authorities of Transport Department and on the aspect of effective implementation of G.O.Ms.No.772, Home (Transport-III) Department, dated 16.10.2014, the principal Bench of this Court, in W.P.No.3007 of 2014, vide order dated 30.10.2014, has already issued directions.

Averments made in the notice sent by V.Karuna, Advocate, High Court, Madurai that unscrupulous auto drivers often dragging the innocent passengers who alight from the bus by way of soliciting them, is not substantiated. In the Public Interest writ petition, the petitioner should furnish proper materials before the Court, before raising his voice in the capacity of pro bono litigant.

Since in the similar matter in W.P.No.3007 of 2014, directions were already issued to the Secretary, Home (Transport) Department, Chennai and the Transport authorities, and when the petitioner is also aware of the fact by enclosing a copy of the said order along with typed set of papers, we do not appreciate filing of writ petitions, one after another, for the same cause. There is no merit in this writ petition.
