ORDER

This Criminal Original Petition has been filed seeking a direction to the second respondent, not to harass the petitioners, on the basis of the petitioners' representation, dated 19.04.2023.

2. The contention of the petitioners is that in spite of the deletion during the course of investigation, he was summoned by the concerned Court. Hence, this Petition has been filed.

3. A report has been called for from the trial Court as to the actual aspects. The report has been submitted by the trial Court, dated 12.05.2023, stating that deletion report was filed and some of the accused were deleted. Notice was issued to the defacto complainant to make his objections. He also appeared and filed objection. After hearing him, the trial Court took cognizance against all the accused, including the deleted accused, in C.C.No.353 of 2022. So, there is no question of harassment here. Because of the above said development, the petitioners is at liberty to work out their remedy, over the orders passed by the trial Court in taking cognizance, if so advised.
