ORDER

The petitioner seeks a direction to the third respondent to comply the order passed by the learned Judicial Magistrate-1, Karur in C.M.P.No.4063 of 2023, dated 09.01.2024 and to direct the second respondent to monitor the investigation.

The gist of the petitioner's case is that the petitioner was attacked by four persons; that an FIR was registered by the third respondent in Crime No.448 of 2020; that the final report was filed only as against two persons; that aggrieved by this, the petitioner had filed a petition before the learned Judicial Magistrate-I, Karur, in C.M.P.No. 4063 of 2023, seeking a direction for further investigation; that learned Magistrate, by the order dated 09.01.2024, directed the third respondent to conduct further investigation and file the final report within a period of one month and that the third respondent has not conducted any investigation sofar.

3.The learned Additional Public Prosecutor appearing for the respondent police, on instructions, would submit that since there were certain compromise talks, the third respondent police did not file the final report as directed by the learned Magistrate. 4.There is no justification for the third respondent police in not filing the final report as directed by the learned Magistrate in the order dated 09.01.2024. The reasons given by the third respondent for not filing the final report also cannot be accepted. The third respondent has admittedly violated the direction issued by the learned Magistrate. Hence, the Deputy Superintendent of Police, Karur, is directed to conduct further investigation in terms of the order passed by the learned Magistrate within a period of four weeks and file a final report. Till the final report is filed, further proceedings before the learned Judicial Magistrate-I, Karur in C.C.No.191 of 2022 shall remain stayed. The learned Magistrate shall proceed with the case after receipt of the further final report.

5.With the above direction, this Criminal Original Petition is disposed of.
