... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the application dated 01.12.2022 submitted by the petitioner through proper channel, the 6th respondent for voluntary retirement.

For Petitioner : Mrs.S.Jessi Jeeva Priya For Respondents : Mrs.M.Parameswari, Standing Counsel.

ORDER

Heard the learned counsel for the petitioner and the learned standing counsel for the respondents.

2.The petitioner is now holding the post of Revenue Supervisor in TANGEDCO. She has given an application for going on voluntarily retirement on 01.12.2022. She has also given a reminder on 02.03.2023. Her grievance is that till date it has not been accepted. That led to the filing of this writ petition.

3.After hearing the learned standing counsel, I am more than satisfied that because the petitioner filed W.P.(MD)No.17470 of 2022 seeking promotion, the authorities have chosen to keep the VRS application in abeyance. I can very well understand the position of the respondents. They probably do not want to prepare the pension papers of the petitioner twice. If the petitioner's voluntary retirement application is accepted right now, the pension papers will be prepared by treating the petitioner as a Revenue Supervisor. If her request made in W.P.(MD)No.17470 of 2022 is allowed, then the petitioner will have to be treated as Assessment Officer. That will lead to double work. 5.Since the other writ petition is also going to be disposed of today, ie., 15.06.2023, I direct the third respondent to permit the petitioner to go on voluntary retirement with effect from 30.06.2023. However, the petitioner's pension papers can be processed within a period of eight weeks thereafter and her pension benefits shall be disbursed as expeditiously as possible.
