O R D E R
The petitioner has filed this Writ Petition seeking a mandamus, directing the second respondent to de-freeze Account No. 42180613122 held at the State Bank of India, Kuruvithurai Branch and to permit the petitioner to operate the said account in accordance with law.
2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3. When the matter was taken up for hearing, the learned counsel appearing on behalf of the respondents submitted that the petitioner has not submitted the requisite legal heir certificate along with supporting proof to the respondent Bank. Therefore, if the petitioner submits the said legal heir certificate, the same will be duly considered and appropriate action will be taken in accordance with law. 2/5

In the light of the above submission, the petitioner is directed to submit the legal heir certificate along with required documents as required to the respondents 2 and 3 within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of such documents, the respondents 2 and 3 shall examine the same and pass appropriate orders on merits and in accordance with law, after giving due opportunity to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of eight weeks thereafter. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents 2 and 3 to consider the same on its own merits.
5. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. 22.04.2025 Index : Yes / No Internet : Yes / No PKN To 3/5
