For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1600 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 392,397 and 506(ii) of IPC, seek anticipatory bail.

2. There are totally four accused in this case and the petitioners herein are arrayed as A3 and A4. The case of the prosecution is that there are two groups of rowdy elements and the petitioners belongs to one group. On the date of occurrence all the accused persons went to the house of the defacto complainant who is a father of an member of the rival group with weapons and criminally intimidated him. Sofar as these petitioners are concerned they have stolen a sum of Rs.240/- from the house of the defacto complainant.

3. The learned counsel for the petitioners would submit that the petitioners are innocent and due to previous enmity a false case has been foisted against them. He would also submit that no previous case is pending against the petitioners.

4. The learned Government Advocate(Crl.Side) would submit that there are two groups of rowdy elements and the petitioners belongs to one rival group. On the date of occurrence all the accused persons went house of the defacto complainant with weapons and criminally intimidated him. Sofar as these petitioners are concerned they have stolen a sum of Rs.240/- from the house of the defacto complainant. He would also submit that A1 and A2 in this case were arrested and remanded to judicial custody.

5. Taking into consideration all the facts and circumstances of the case and also the allegations levelled against the petitioners that they have stolen money from the defacto complainant and also taking into consideration the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Hence the petition stands dismissed.
