For Respondent : Mr.T.Senthilkumar, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For bail in Crime No.357 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 26.06.2021, for the offence punishable under Sections 8(c) r/w. Sections 20(b)(ii)(C) and 25 of NDPS Act, in Crime No.357 of 2021 on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of 40 kgs of ganja in Hyundai Creeta White Car bearing Reg.No.TN58BW 0155. Hence, the case.

3. This is the third bail petition. Considering the nature of offence, the quantity of the contraband and also the fact that the contraband has been seized from the petitioner, this Court dismissed the earlier bail petitions, vide order dated 04.10.2021 and 02.12.2021 respectively.

4. Since there is no change in circumstances of the case to consider the present petition, this Court is not inclined to grant bail to the petitioner.

5. At this juncture, the learned counsel appearing for the petitioner submits that while dismissing the second bail petition, this Court vide order dated 02.12.2021, directed the learned trial Judge, to conclude the trial within a period of four months from the date of receipt of a copy of the order. However, the trial is not yet completed.

6. The learned Additional Public Prosecutor submits that the case stands posted on 27.06.2022 and undertakes that on that day, the prosecution would produce all the witnesses, so that, the trial could be completed within a reasonable time.

7. Recording the same, the Criminal Original Petition is dismissed with liberty to the petitioner to raise all the grounds before the trial Court.
