O R D E R
Challenging the rejection order dated 01.04.2025, issued by the first respondent in relation to the petitioner's request for a new electricity service connection, the present Writ Petition has been filed.
2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The petitioner claims to be the patta holder of the land situated in Survey No.367/7A1A3. The petitioner submitted an application seeking separate electricity service connections for newly 2/6
constructed houses on the said land. However, the first respondent rejected the petitioner's application by passing the impugned proceedings, stating that the plan approval for the said constructions had been cancelled by the second respondent. Challenging the same, the present writ petition has been filed by the petitioner.
4. The learned Standing Counsel appearing on behalf of the first respondent would submit that the letter communication sent to the petitioner was for the purpose of seeking explanation and if the petitioner provides the explanation, the same will be duly considered by the first respondent and shall pass appropriate orders in accordance with law.
5. In view of the submissions made by both parties, this Court directs the petitioner to submit an explanation before the first respondent, citing all the grounds raised in this writ petition, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said explanation, the first respondent shall pass final orders on merits and in accordance with law, after affording a fair opportunity of hearing to the petitioner, within a further period of four weeks. 3/6
6. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. 22.04.2025 Index : Yes / No Internet : Yes / No PKN 4/6
