ORDER : The Court made the following order :- The petitioner / A2, who was arrested and remanded to judicial custody on 18.12.2022 for the offences punishable under Sections 147,148,341,302,506(2) of IPC in Crime No.202 of 2022 on the file of the respondent police, seeks bail.

The case of the prosecution is that the complaint's husband, the deceased Suresh, aged 45, owned Sri Traveis and had, purchased 3.5 acres of agricultural land in Sambiranipatti, Melur Taluk, Madurai District, about 9 years prior. There was ongoing enmity over adjacent land boundaries. Previously, in 2020, a case was registered against the petitioner and others in Cr.No.39 of 2020 for attempt to murder under Section 307 of IPC and provisions of the SC/ST (POA) Act, based on a complaint by Lakshmanan, where the deceased Suresh and his father-in-law Pon. Dharmarajan were witnesses. On the date of occurrence, while the deceased was returning from his coconut grove in his car (TN 57 BU 3745) near Sambiranipatti Mandai at around 18:30 hrs, the accused, including ese petitioners, stopped him due to prior enmity over land disputes. The accused attacked him with sickles (aruval) and sticks (kattai), causing fatal injuries to his left forehead, right side of head, right ear, back of head and other parts, leading to his death on 2/6

the spot in a pool of blood. The complainant learned of the incident around 19:00 hrs from Prakash, son of Machakkalai, and upon inquiry, locals informed that accused 1, 8, 4, 2, 3 and 5 attacked with sickles and accused 7 with a stick, and the female accused 6 and 9 held and assaulted him. Hence, this case.

The learned counsel for the petitioner would submit that the respondent police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution. The petitioner has been arrested and remanded to judicial custody on 18.12.2022. Hence, he prays to grant bail to the petitioner.

The learned counsel appearing for the intervenor vehemently objected to grant bail to the accused stating that if he is enlarged on bail he would make an attempt to intimidate and tamper the witnesses and there is a likelihood of life threat to the witnesses and the accused may stall the progress of criminal cases.

5. The learned Additional Public Prosecutor appearing for the respondent would submit that while the deceased was returning from his 3/6

coconut grove in his car (TN 57 BU 3745) near Sambiranipatti Mandai at around 18:30 hrs, the accused persons attacked him with sickles leading to his death. He would further submit that now the case has been transferred to CBCID. Hence, he opposed to grant bail to the petitioner.

6. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side and also considering the fact that this Court has already transferred the investigation from the respondent police to CBCID and the investigation by the CBCID is pending at the initial stage and consequence upon previous case registered the present occurrence had happened and the petitioner is also having some previous cases, this Court is not inclined to grant bail to the petitioner.

8. Hence the petition stands dismissed.
