ORDER

This Transfer Civil Miscellaneous Petition has been filed to withdraw the case on the file of the learned Sub Court, Mettur, Salem District in H.M.O.P.No. 33 of 2023 and transfer the same to the learned Sub Court, Sivakasi, Virudhunagar District.

2. Although private notice has been ordered, proof of service has not been filed. Court notice has been served on the respondent. The name of the respondent also printed in the cause list, despite the respondent has not appeared.

3. Considering the averments in the petition filed by the petitioner for transfer of H.M.O.P.No.33 of 2023 pending on the file of the Sub Court, Mettur, Salem District, this Court is inclined to allow this transfer civil miscellaneous petition by transfer the above case to the Sub Court, Sivakasi, Virudhunagar District. The Sub Court, Sivakasi, Virudhunagar District shall endeavour to dispose the H.M.O.P.No.33 of 2023 as expeditiously as possible preferably, within a period of 18 months from the date of receipt of a copy of this order.

4. Accordingly, this Transfer Civil Miscellaneous Petition stands allowed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition stands closed.
