Respondents Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents herein to grant permission to conduct the Kabadi Game on 24.01.2015 and 25.01.2015 in pursuant to the Pongal Festival at Avarampatti, Malaiyadipatti Village, Manaparai Taluk, Trichy District considering the representation of the petitioner dated 13.01.2015. For Petitioner : Mr.M.Suresh For Respondent : Mr.R.Karthikeyan, Additional Government Pleader.

O R D E R

Heard the learned counsel for the petitioner and Mr.R.Karthikeyan, learned Additional Government Pleader who takes on behalf of the respondents. By consent, the writ petition itself is taken up for final disposal.

2.The prayer in the writ petition is to direct the respondents to grant permission to conduct Kabadi tournament on 24.01.2015 and 25.01.2015 pursuant to the Pongal Festival at Avarampatti, Malaiyadipatti Village, Manaparai Taluk, Trichy District considering the representation of the petitioner dated 13.01.2015.

3.Today when the matter came up for hearing, on instructions, learned Additional Government Pleader submitted that they have no objection, if the kabadi tournament is conducted in Avarampatti village or in the colony of the petitioner.

4.Therefore, the petitioner is directed to give a fresh representation to the authorities citing the place mentioned by them on or before 29.01.2015. On receipt of the same, the authorities will consider the same and pass appropriate orders imposing following conditions and/or any other conditions as it may think fit.

"i)The Kabadi Tournament is permitted to be held on 31.01.2015 and 01.02.2015 between 10.00 a.m to 07.00 p.m. only. ii)The petitioner and other participants shall not shout, raise any slogan for or against any party or party leader, any cast, community or creed.

iii)The petitioner shall ensure that no untoward incident is caused disturbing the public peace and tranquility;

iv)The petitioner shall ensure proper first-aid arrangements by keeping one or two doctors in the venue.

v)The participants of Kabadi Tournament shall not wear any form of dress showing offending slogans or picture of any communal/political leader which may cause disturbance.

vi)Songs praising communal leader or having communal overtones should not be played.

vii)The petitioner will ensure that no flex board or hoardings depicting particular community or leader is displayed 5.If any of the above said conditions are violated, it is open to the respondents to take appropriate action, in accordance with law. 6.The writ petition is disposed of in the above terms. No costs.
