Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider the petitioner's claim for retirement benefits and the entire amount due to him in accordance with the law within a time frame.

O R D E R

[Order of the Court was made By The Hon'ble The Chief Justice] Learned counsel for the respondent concedes that there are dues owing to the petitioner due retirement benefit, but major portions stated to have been paid after earlier representation of the petitioner.

2. The petitioner superannuated on 31.01.2014 and more than one year has passed. We fail to appreciate how the petitioner is expected to sustain himself, if dues are not settled expeditiously.

3. We are of the view that in all such cases, dues must be settled within a maximum period of three months from the date of superannuation. Since the dues have been paid belatedly, some dues are still to be paid, a direction is issued to the respondent to remit the full amount within one month from today, giving details of how they have been worked out, along with interest payable on delayed payment.

4.The writ petition accordingly stands disposed of. No costs.
