PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 2nd respondent to give adequate Police protection to the petitioner and her family members on the basis of the petitioner's representation dated 16.09.2020. For Petitioner : Mr.K.Arunraj For R1 & R2 : Mr.K.Sanjai Gandhi Government Advocate (Crl. side)

ORDER

(This petition is heard through video conference) This petition has been filed seeking direction to the 2nd respondent to give adequate Police protection to the petitioner and her family members on the basis of the petitioner's representation dated 16.09.2020.

Crl.O.P.(MD).No.8991 of 2021 2.When the matter is taken up for hearing on earlier occasion, the learned Government Advocate (Crl. Side) submitted that based upon the complaint given by the petitioner enquiry was undertaken and during the course of enquiry summon was issued to both parties and both parties appeared. At that time, the private respondent gave an undertaking that they will not make any trouble to the petitioner and based upon the undertaking given by the private respondent, the complaint has been closed.

3.Closure report has been circulated by the learned Government Advocate (Crl. Side) today. Since the representation has been closed based on the undertaking given by the private respondent, question of granting police protection does not arise. If any trouble arises in future in violation of undertaking given by the private respondent, the petitioner is at liberty to work out their remedy through property proceedings.

4.With the above liberty, this criminal original petition is disposed of.
