Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent herein to enquire the application/petition dated 07.01.2020 filed by the petitioner under Section 3G (5) of the National Highways Act, 1956, on merits and pass order within the time period stipulated by this Court.

Heard the learned counsel on either side.

2.The petitioner's land was acquired under the National Highways Act, 1956. The petitioner was also granted compensation. The petitioner not satisfied with the quantum filed a petition under Section 3G (5) of the National Highways Act, 1956. The first respondent is the competent authority to dispose of the same. The petition was filed way back on 07.01.2020. Matters relating to disbursement of compensation in acquisition related cases should be dealt with expeditiously. Therefore, the petitioner's request for speedy disposal cannot be objected to. The first respondent is directed to dispose of the petition mentioned petition on merits and in accordance with law within a https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.11179 of 2020 period of 12 weeks from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. The petitioner's counsel states that there is no rival claim. However, the first respondent will put all the stake holders and interested persons on notice before passing final orders.

3.The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
