2. For the same issue, another person has approached the civil Court, which is now pending before this Court in S.A(MD).No.889 of 2005. Therefore, reagitating the issue by way of this writ petition cannot be entertained.

3. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
