For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor For Intervenor : Mr.B.Santhanam Rajeshkumar, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.7/2022 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A1, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 468, 471, 468, 420 and 120B IPC in Crime No.7 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that the respondent police have already sent their final report for approval to the Assistant Public Prosecutor, wherein, they have concluded that further action has to be dropped.

3.At this juncture, the learned counsel for the de-facto complainant would submit that without proper enquiry, they have decided to drop the further action and that they are having every right to challenge their report.

4.As rightly contended by the learned Additional Public Prosecutor, since the respondent police has decided to drop further action, nothing survives for further adjudication in this petition. 5.Hence, this Criminal Original Petition is dismissed as infructuous. The de-facto complainant is at liberty to file a protest petition on receiving the RCS notice.
