Prayer in WP(MD). 3665/ 2021 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue order to directing the Learned 1st Additional District and Sessions Court, Madurai to conclude the Trial in S.C.No.470 of 2020 within a stipulated period.

ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. V.Rajiv Rufus, Advocate for the Petitioner and of M/s. M.Muthumanikkam, Government Advocate for the respondent this Court made the following order: "This Court, while disposing of W.P.(MD)No.3665 of 2021, on 18.03.2021, directed the learned I Additional District and Sessions Judge, Madurai, to conduct the trial expeditiously and dispose of the case in S.C.No.470 of 2020 within a period of six months from the date of receipt of a copy of the order.

2. Subsequently, time was extended by this Court on several occasions, based on the requisition letter sent by the trial Court. However, trial is not yet concluded.

3. Therefore, the petitioner, who is the wife late Jeyaraj, has filed this petition seeking a direction to the learned I Additional District and Sessions Court, Madurai to conduct the regular Court proceedings in the summer vacation in S.C.No.470 of 2020 enabling the trial to be concluded at the earliest. 2/4

4. Heard the learned counsel appearing for the petitioner as well as the learned Government Advocate (Crl. Side).

5. Considering the facts and circumstances of the case and also considering the submissions made herein, this Court directs the learned I Additional District and Sessions Judge, Madurai, to conduct the trial expeditiously and dispose of the case in S.C.No.470 of 2020 within a period of three months from the date of receipt of a copy of this order. It is made clear that no further extension of time will be granted in future.

6. Accordingly, this petition is ordered. "
