O R D E R
[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The petitiner is the father of the detenu. The present Miscellaneous Petition is filed seeking a direction to direct the respondents to temporarily release the detenu Sachin @ Richard Sachin, S/o.Dhanasamy, aged 25 years, (Detenu No.9202) detained as Goonda at Central Prison, Madurai in order to take treatment for alleged Gunshot injury sustained while chasing by the police.
2. The learned counsel for the petitioner would submit that the detenu has suffered Gunshot injury on the right leg and knee with compound fracture, which needs immediate surgery and hence, seeks for temporary release for taking treatment at Private Hospital.
3. The learned Additional Public Prosecutor appearing for the respondents would submit that this Court by an order dated 24.04.2025 had directed the Jail authorities to obtain a report from the Medical Board at Rajaji Government Hospital, Madurai and submit it before this Court. He would further submit that as 2/5
per the order of this Court, a Medical Report dated 28.04.2025 has been produced before this Court. As per the Medical Report, the Medical Board has suggested that the patient suffers from Right knee stiffness with o to 10o of flexion and Right foot drop and they also stated that these conditions can be treated at Government Rajaji Hospital, Madurai. The authorities are taking steps to admit the detenu in the Government Rajaji Hospital, Madurai.
4. We have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. We have also perused the materials including the report of the Medical Board.
5. In view of the above, a direction is issued to the third respondent to admit the detenu namely Sachin @ Richard Sachin, S/o.Chanasamy, aged about 25 years detained as Goonda at Central Prison, Madurai in the Government Rajaji Hospital, Madurai for taking treatment, within a period of two weeks from today. The Dean, Government Rajaji Hospital, Madurai shall ensure that proper treatment is given to the detenu.

6. With the above directions, this Criminal Miscellaneous Petition is ordered.
