RESPONDENT / COMPLAINANT For Petitioner : Mr.K.SUDALAIYANDI, Advocate For Respondent : Mr.A.ROBINSON, Government Advocate(Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 I.P.C, in Crime No.414 of 2018, seeks anticipatory bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal side) for the respondent. 3.The defacto complainant is said to have supplied goods to the petitioner. There was some dispute regarding repayment. The learned counsel for the petitioner, on instructions of the petitioner, undertakes to pay a sum of Rs.50,000/- to the defacto complainant within a period of four weeks. It is made clear that this condition is imposed only for the purpose of granting relief to the petitioner. It does not foreclose the rights of the defacto complainant.

4.Therefore, the petitioner is directed to pay a sum of Rs.50,000/-(Rupees fifty thousand only) directly to the defacto complainant within a period of four weeks from the date of receipt of a copy of this order.

5.Subject to this condition, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned https://hcservices.ecourts.gov.in/hcservices/

Judicial Magistrate No.I, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
