To set aside the order made in WP(MD) No.15687 of 2018 dated 29.11.2021 on the file of this Hon'ble Court and allow the writ appeal. Prayer in WP(MD). 15687/ 2018 :
Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus directing the respondents to fix the salary in the cadre of Work Inspector from the month of May 2001 consequently sanction the service benefits as per G.O.Ms.No.12, Public Works Department dated 20/01/2009 by considering the petitioner's representation dated 23/11/2017 within a period stipulated by this Honourable Court.
ORDER : This civil miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.P.MAHARAJAN, Special Government Pleader for the petitioners and of Mr.M.JERIN MATHEW, Advocate on behalf of the Respondent, the Court made the following order:- (Order of the Court was made by D.KRISHNAKUMAR, J.) This petition is filed to condone the delay of 538 days in filing the W.A.SR.(MD)No.31088 of 2023.
2.Though we are not satisfied with the reasons stated in the affidavit filed in support of this petition and normally we are not inclined to condone such inordinate delay, considering the fact that the order of the Writ Court seeks for some 2/4
clarification, we are inclined to condone the delay on payment of cost. Therefore, the delay is condoned and this petition is allowed on payment of Rs.5000/- (Rupees Five Thousand Only) to the credit of the Environmental Fund Operated by Member Secretary, Tamil Nadu State Legal Services Authority [Account No.6656485009; IFSC Code: IDIB000H040, High Court Branch, Chennai] within a period of two weeks from today.
