: Respondent Prayer: Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Habeas Corpus, directing the respondent to produce the person or body of detenu, namely Sangeetha, aged about 26 years before this Court and set her at liberty.

ORDER

****** (Order of the Court was made by S.NAGAMUTHU, J.) The petitioner is the father of one Sangeetha, aged 26 years. She is a Post-Graduate having M.Sc., and B.Ed., degree to her credits. She was working as a teacher in a local School. According to the petitioner, she has been found missing from 02.06.2016 onwards. In connection with the same, on a complaint made by the petitioner, the respondent police has registered a case in Crime No.32 of 2016 for woman missing. Since the detenu has not been, so far, secured, the petitioner has come up with this Habeas Corpus Petition.

2. We have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. We have also perused the records carefully. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public Prosecutor would submit that the investigation has revealed that the detenu has eloped with one

Mr.Stephen Sudhakar, who is employed in Bangalore. He would further submit that it is not a case of either abduction or missing. The said statement is recorded.

4. In view of the same, since the investigation is in progress, except making an observation that the respondent shall expedite the investigation, we are unable to grant the relief as prayed for in this Habeas Corpus Petition.

5. The Habeas Corpus Petition is dismissed with the above observation.
