This Crminal Miscellaneous Petition filed under section 482 of Cr.P.C., praying this Court to extend the time fixed in Crl.O.P. (MD) No. 16743 of 2019 dated. 18.11.2019 by another Five months to file Final Report before the Jurisdictional Court and pass such further or other orderas as this Hon`ble Court. Prayer in CRL OP(MD). 16743/ 2019 :

This Crminal Original Petition filed under section 482 of Cr.P.C., praying this Court to call for the records in Connection with Cr.No.1/2019 on the file of the Inspector of Police, CBCID South, Madurai City and quash the same.

ORDER:- This Crminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.B.Thanga Aravindh Government Advocate (Crl Side) for the Petitioner and of . Mr.RM.Mahesh Kumaravel, Advocate for the respondents, this Court made the following order:

This petition has been filed seeking extension of time to comply with the order passed in Crl.O.P.(MD)No.16743 of 2019, dated 18.11.2019.

2.Earlier, the petitioner has filed an application for extension of time in Crl.M.P.(MD)No.9368 of 2021 and this Court, vide order dated 25.11.2021, has granted five months time to comply with the order passed in Crl.O.P.(MD)No.16743 of 2019, dated 18.11.2019. Now, the petitioner has come forward with the present application seeking further period of six months time to complete the investigation and to file the final report. 3.Heard the learned counsel on either side.

4.When the matter is taken up for hearing, the learned counsel for the respondent would submit that this Court directed the respondent to submit all the relevant documents pursuant to the allegations before the petitioner. But the petitioner has been refusing to receive the same.

5.Considering the reasons assigned in the affidavit filed in support of the above petition and the submission made by the learned counsel on either side, this Court is inclined to grant three months time to complete the investigation and to file the final report as finally and no further time will be granted. However, the respondent is directed to handover the relevant documents referred in the earlier order dated 18.11.2019 to the petitioner and on such production, the petitioner is directed to receive the same and proceed as per the order dated 18.11.2019.
