PRAYER :- For Bail in Crime No.4 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 28.02.2023 for the offence punishable under Sections 5(j)(ii)r/w.6 of POCSO Act,2019 in crime No.4 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner herein under the pretext of love had committed penetrative sexual assault on the minor victim girl and also threatened her not to disclose the same to anyone, hence the case.

3. Heard both sides and perused the materials available on record including the First Information Report and also the statement of the victim recorded under section 164 of Cr.P.C.

4. Taking into consideration the serious offence committed by the petitioner this Court had already dismissed the petition filed by the petitioner on 05.04.2023 in Crl.O.P(MD) No.6107 of 2023. Further even after the dismissal of the earlier petition there is no https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.7736 of 2023 change in circumstances of the case to consider the present petition.

5. Hence the petition stands dismissed.
