Mr.H.Arumugam, learned counsel for the petitioner submitted that his application under Order 21 Rule 95 r/w 151 CPC was dismissed on the ground that he was not a party to the suit. According to him, there is a connected CRP(MD).No.3247 of 2024 is pending before this Court, wherein, the impugned order is stayed.

The present proceedings is consequential proceedings, where he is not made as party in E.P.No.56 of 2007.
