PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C. to call for the records pertaining to FIR in Crime No.137 of 2019 on the file of the first respondent Police and quash the same as against the petitioner.

ORDER

The Criminal Original Petition is filed to quash the proceedings in Crime No.137 of 2019 on the file of the first respondent Police, as against the petitioner.

The learned counsel appearing for the petitioner submitted that the 2nd respondent lodged a complaint before the 1st respondent police, and on that basis, FIR was registered against the petitioner in Crime No. 137 of 2019, dated 28.07.2019 for the offences under Sections 294(b), 504 and 506(i) of IPC and Section 67 of Information Technology Act, 2/6

2000. To quash the same, the present petition has been filed.

When the matter is taken up for hearing today (18.09.2025), the learned counsel appearing on either side was present, and the petitioner as well as the 2nd respondent were also present in person before this Court and submitted that they have amicably resolved their issue. To that effect, they have also filed a joint compromise memo dated 20.04.2023.

4. Both parties were identified by their respective counsel, and their identities were also verified by this Court. A Joint Compromise Memo has been filed by the learned counsel appearing on either side, which has been signed by both parties, and the relevant portions thereof are extracted hereunder:

"1. It is submitted that based on the compliant preferred by the defacto complainant, the 1st respondent police has registered a case in Crime No. 137 of 2019, for the alleged offences under Sections 294[b], 504, 506 [i] of IPC and Section 67 of Information Technology Act, 2000 3/6

on the file of the 1st Respondent Police.

2. It is submitted that as per the advice of the elders, the petitioners and the 2nd respondent amicably resolved their dispute and they were entered into compromise.

3. It is submitted that the continuation of first information would be a futile exercise in view of the compromise. Moreover, this Hon'ble Court is having amble power to quash the FIR, based on the compromise between the parties."

5. The above terms of the Joint Compromise Memo were read over and explained to both parties in the presence of their respective counsel, and both parties submitted that the same were correct. Accordingly, the said Joint Compromise Memo is recorded.

6. Considering the overall facts and circumstances of the case, and taking note of the fact that both sides have compromised the matter, this Court is inclined to exercise the inherent powers of this Court under Section 528 of the B.N.S.S. to quash the case on the basis of the compromise.

7. Accordingly, this Criminal Original Petition stands allowed, and the proceedings in Crime No.137 of 2019 on the file of the first respondent Police shall stand quashed as against the petitioner. The joint compromise memo shall form part and parcel of this order.
