O R D E R

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.II, Padmanabhapuram, Kanyakumari District to dispose of the case in C.C.No. 1407 of 2018 within the stipulated period.

2.According to the petitioner, the petitioner is the accused in this case. Based on the complaint of the defacto complainant, a case has been registered by the respondent police in Cr.No.159 of 2018 against the petitioner and other accused persons. Though the case has been registered in the year 2018, so far trial has not been completed. Therefore, seeks for speedy disposal and this petition has been filed. 3.The learned Government Advocate (Crl.Side) would submit that based on the complaint of the defacto complainant/R2, a case has been registered in Cr.No.159 of 2018 for the offence punishable under Sections 147, 148, 294(b), 324, 323 and 506(i) IPC and Section 4 of TNPHW Act, 2002. After completion of investigation, they have filed the charge sheet before the concerned Court. In this case, so far PW1 to PW5 were examined and posted for examination of further witnesses 6 to 2/4

The respondent police is ready to produce the witnesses as directed by the trial Court and co-operate to complete the trial proceedings. 4.Considering the limited scope of the prayer sought for by the petitioner and also considering the long pendency of the case, this Court hereby direct the learned Judicial Magistrate No.II, Padmanabhapuram, Kanyakumari District to complete the trial proceedings in C.C.No.1407 of 2018 as early as possible without giving long adjournments, beyond 1 week.

5.With the above direction, this Criminal Original Petition stands disposed of.
