For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For an Anticipatory Bail in W.L.O.R.No.9 of 2019 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who is the sole accused, apprehending arrest at the hands of the respondent police for the offences punishable under section 39(i), (ii), (iii), (v) and 51 of Wildlife Protection Act, 1972, in W.L.O.R.No.9 of 2019 on the file of the respondent police, seeks anticipatory bail.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

3.This is the second application. Earlier, the petitioner has filed a petition seeking anticipatory bail in Crl.O.P.(MD).No.18604 of 2019, and this Court, by order dated 13.12.2019 dismissed the same holding that the petitioner is having one previous case, and without disclosing the above said facts, the present petition has been filed.

4.That apart, The petitioner was in possession of 175 Kgs of sea cucumber illegally and he is also having one previous case. Considering the facts and circumstances of the case and there is no change of circumstances to entertain this application and the fact that the petitioner is having one previous case and he is a habitual offender, I am not inclined to grant anticipatory bail to the petitioner.
