: Respondents Prayer: Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Habeas Corpus, directing the respondents to produce the person or body of the detenu Subramani, S/o.Palanisamy, aged 39 years and set him at liberty.

O R D E R

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner is the wife of one Mr.Subramani, S/o.Palanisamy, aged 39 years. According to the petitioner, Mr.Subramani, the detenu has been found missing from 24.05.2016 onwards. Since the whereabouts of the detenu are not known, the petitioner has come up with this Habeas Corpus Petition.

2. The learned Additional Public Prosecutor, on instructions, would submit that the detenu has eloped with one Mrs.Kalavathi, aged about 38 years. On a complaint made by the husband of Mrs.Kalavathi, a case has been registered for woman and children missing and the same is under investigation. During investigation, it came to light that Mrs.Kalavathi has eloped with the detenu taking the children also with her.
