O R D E R

This petition is filed seeking a direction to the second respondent herein to provide police protection to the petitioner on the basis of her representation dated 03.07.2021.

2. The case of the petitioner is that she owns a commercial complex, called "Little Rose", which contains 16 shops. She wanted to put up a new construction by demolishing the same. So, she requested all the tenants to vacate the shops. The respondents 3 and 4 are tenants and they refused to vacate the shops and instead, they gave a false complaint against her, in respect of which, a case has been registered against her. The petitioner is aged about 60 years and she is living alone, since her husband is in abroad. When the petitioner asked the 3rd and 4th respondents to vacate the shop, they abused her in filthy language and gave life threat to the petitioner. Hence, this petition.

Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor submits that based on the complaint given by the petitioner, a case has been registered in Cr.No.70 of 2021, against the respondents 3 and 4, for the offences under Sections 294(b) and 506(i) of IPC, on 08.07.2021.

4. It is seen that based on the complaint given by each other, a case has been registered against both the parties. Therefore, the question of granting police protection does not arise.

5. In view of the above, this Criminal Original Petition is dismissed.
