Prayer: Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Habeas Corpus, directing the respondents to produce the petitioner's son, namely Kailasam, son of Soodamanipillai, aged 36 years before this Court and set him at liberty.

ORDER

****** (Order of the Court was made by S.NAGAMUTHU, J.) The petitioner is the mother of one Mr.Kailasam, S/o.Soodamani Pillai, aged 36 years. According to the petitioner, the detenu was employed in a Private Company at Tiruppur and from 23.02.2007 onwards, he has been found missing. According to the petitioner, a complaint was made to the police on 21.01.2009, but, no action has been taken so far, is her grievance. Therefore, she has come up with this Habeas Corpus Petition seeking a direction to the respondents to trace out the missing man and to produce him before this Court.

2. We have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. We have also perused the records carefully.

3. For a person, who was found missing, that too, at Tiruppur, a complaint was made to the second respondent in Tuticorin District only in the year 2009. At any rate, as submitted by the learned Additional Public Prosecutor, every effort is being taken by the respondents to trace out him.

4. When that be so, no further direction is required in this matter, except making an observation that the second respondent shall register a case and investigate the matter in accordance with law.

5. The Habeas Corpus Petition is dismissed with the above observation.
