PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to pass an order permitting the petitioners to surrender before the learned Special Court for Exclusive Trial of Cases Under SC/ST (POA) Act,1989 / 1/4

Sessions Judge (FAC), Dindigul, in Crime No.177/2026 and file an application for the grant of bail on the same day in the event of filing the same, the said application may be directed to be considered on the same day on merits in accordance with law forthwith.

ORDER

The present petition has been filed by the accused persons in crime No. 177 of 2026, on the file of the second respondent police wherein the petitioners are alleged to have committed offences under the SC/ST (Prevention of Atrocities Act), 1989, other offences under BNS, 2023 and the Tamil Nadu Prohibition of Harassment of Women (Amendment) Act, 2002, seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of surrender.

2. Considering the averments in the petition, there shall be a direction to the learned Special Court for exclusive trial of cases under SC/ST (POA) Act, 1989 / Sessions Judge (FAC), Dindigul, to consider the bail application of the petitioner on the same day of surrender in crime No.177 of 2026, after giving due opportunity to the defacto complainant.

3. With the above said observations, this Criminal Original Petition stands allowed.
